iPhone

My aunt is possibly getting the iPhone 3GS, leaving her iPhone 3G unused. If she does happen to get the new one, I was going to ask her if I could have her old one. I have a Samsung phone with no data, and if I were to get the iPhone I'd just use wifi for internet. I was just wondering if AT&T would find out that I'm using an iPhone and charge me the $30 extra a month. If anyone could let me know that'd be greatly appreciated!
